Public Disclosure of Arrangements under the ACO Pre-Participation and ACO Participation Waivers

The Centers for Medicare & Medicaid Services and the Office of the Inspector General have issued waivers of the application of certain federal fraud and abuse laws to specified arrangements involving ACOs participating in the Medicare Shared Savings Program. New York Medical Partners ACO, LLC (“NYMP”) seeks protection under the Medicare Shared Savings Program ACO Participation Waiver for the following arrangement:

    • Effective July 1, 2019, NYMP and CVS Pharmacy, Inc. (“CVS”), have entered into an arrangement under which CVS will provide medication management services to NYMP ACO attributed patients. Services include the provision of medication adherence information to the ACO and direct messaging to patients regarding gaps in preventive care measures such as vaccines and diagnostic tests. The intent of the arrangement is better enable NYMP to manage and coordinate the care of its attributed patients in furtherance of the goals of the Medicare Shared Savings Program.
